Attorney General Dave Sunday Joins Lawsuit to Block 23andMe Data Sale

Attorney General Dave Sunday announced that Pennsylvania has joined a bipartisan coalition of 28 Attorneys General in filing a lawsuit to prevent the sale of consumer genetic data by 23andMe following the company’s bankruptcy filing.

The lawsuit, filed June 9 in federal bankruptcy court, seeks to block 23andMe from selling or auctioning off personal genetic data collected from millions of consumers without their knowledge or consent.

23andMe, a direct-to-consumer DNA testing company, recently filed for bankruptcy and is now attempting to sell its assets, including sensitive genetic and health information, in a high-stakes auction. The lawsuit argues that this data—such as biological samples, DNA information, and health traits—is too personal to be treated as property and sold without informed consent.

Attorney General Sunday stated that many consumers, including Pennsylvanians, did not expect their data to be resold and encouraged individuals to consider deleting their data from the company’s database. He also reminded consumers that the deadline to file proofs of claim in the bankruptcy case is July 14, 2025.

Consumers can file a proof of claim or obtain more information about the bankruptcy at: https://restructuring.ra.kroll.com/23andMe/Home-Index. Those impacted may also file a complaint with Pennsylvania’s Bureau of Consumer Protection or call the Consumer Protection Hotline at 1-800-441-2555.

Other states joining the lawsuit include Arizona, Colorado, Connecticut, the District of Columbia, Florida, Illinois, Kansas, Kentucky, Louisiana, Maine, Michigan, Minnesota, Missouri, New Hampshire, New Mexico, New York, North Carolina, Oklahoma, Oregon, South Carolina, South Dakota, Utah, Vermont, Virginia, Washington, West Virginia, and Wisconsin.
