Pennsylvania is part of a national coalition that has reached a $400 million settlement with generic drug manufacturers Sandoz Inc. and Fougera Pharmaceuticals Inc., Attorney General Dave Sunday announced.
The settlement would resolve allegations that the companies conspired to inflate and manipulate prices, reduce competition and restrain trade involving numerous generic prescription drugs.
A motion seeking preliminary approval of the settlement was filed in the U.S. District Court for the District of Connecticut in Hartford.
Pennsylvania is expected to receive more than $14.8 million. Up to $9.19 million would be designated for consumer restitution, with the remainder going to state agencies.
Consumers who purchased an eligible generic drug between May 2009 and December 2019 may qualify for compensation. Eligibility information is available by calling 1-866-290-0182, emailing info@AGGenericDrugs.com or visiting www.AGGenericDrugs.com.
Under the settlement, Sandoz also agreed to internal reforms intended to promote competition and compliance with antitrust laws. The agreement would resolve claims involving Sandoz’s current and former international affiliates, including Novartis AG, Sandoz AG and Sandoz Group AG.
States previously secured settlements totaling approximately $96.5 million with Glenmark, Lannett, Bausch, Apotex and Heritage in the same litigation.
The coalition’s antitrust cases began in 2016 and involve multiple generic drug manufacturers, pharmaceutical executives and prescription drugs. The investigations have included testimony from cooperating witnesses, more than 20 million documents and phone records involving more than 600 sales and pricing employees in the generic drug industry.
